11 Lezo town officials face malversation charges

KALIBO, Aklan – Councilor Conrado Arcenio filed another complaint against 11 Lezo town officials before the Office of the Deputy Ombudsman for the Visayas for technical malversation of funds.
Arcenio said they conspired with one another and committed acts by causing an ordinance to be passed allowing the diversion and application of public funds to a different intent and purpose other than it was originally appropriated by a law or ordinance.
Those charged were Lezo mayor Victor Fernandez, Municipal Budget Officer Evelyn Legaspi and nine Sangguniang Bayan (SB) members – Lucresia Sabar, Webster Apolonio Ibabao, George Villanueva, Rodulfo Taran, Arnold Revestir, Fernando Baldomero, Albane Nepomuceno, Lezo Sangguniang Kabataan vice president Mae Jane Geralde and Liga ng mga Barangay president Osias Prado.
In his 15-page complaint on October 24, 2007, Arcenio said the illegal diversion of funds was committed since the funds intended for the lump sum salary increase of SB Lezo employees effective July 1, 2007 were diverted to “unauthorized and highly irregular monetization of leave credits without an approved ordinance.”
The P300,000 lump sum appropriation for employees was part of the P33.253-million annual budget of Lezo for 2007.
A total of P207,589.26 for monetized leave credits was released without an appropriation ordinance to validate the release of public funds, Arcenio added.
“This was aggravated by the P78,000 given to Commission on Elections (Comelec) on May 28, 2007 without explanation as to the propriety of releasing funds and was charged to previously appropriated funds intended for Lezo employees only,” he said.
Arcenio said the amount received by Comelec was charged to the Lump Sum Appropriation for Employees’ Benefits, but, he pointed out, the election officials and employees should draw their salaries from the Comelec and not from the coffers of Lezo municipal government.
He further stressed the diversion of funds was passed under the guise of an Augmentation Ordinance No. 4 of P100,000 out of the P300,000 appropriation for terminal leave benefits of SB Lezo.
Vice Mayor Philip John Buenaflor and Arcenio abstained from signing the Augmentation Ordinance citing Section 336, Chapter 4, of Republic Act No. 7160, or the Local Government Code of 1991 on the use of appropriated funds and savings.
Earlier, Arcenio asked the Ombudsman to investigate Fernandez, Municipal Engineer Glendy Inolino and Engr. Carlito Quindor, owner/contractor of C.M. Quindor Construction and Supply for malversation of public funds and a violation of Section 3 of Republic Act 3019, or the Anti-Graft and Corrupt Practices Act.

DOC VIRAY’S CASE HIBERNATING
THE investigation conducted by the Provincial Board of Aklan on the case of Doc Viray for alleged fake credentials has been sleeping for six (6) months now.
No result has been made and no charges whatsoever has been filed against the “doctor” who became chief of various district hospitals in the province and those who were involved in his appointments, including the concerned officers of the Civil Service Commission who certified as genuine the alleged fake documents submitted by the “doctor” of medicine.
The people of Aklan are wondering why the honorable and talented members of the SP continue to remain silent and unaffected by the scandalous tenure of office of the “doctor” who happens to be the brother-in-law of a congressman and a brother of a mayor of one of the towns of Aklan.
Gov. Lito is also silent and unaffected by such outrageous appointment and official activities of Doc Viray.
The continued silence of the handsome governor is a tacit admission of the anomalous management of the popular “doctor” who ludicrously put the medical profession a laughingstock.
As head of the SP, sad to say, Vice Gov. Inday Billie is also like a monkey who sees nothing, hears nothing and says nothing.
All the honorable officials of the province, including our favorite, ebullient and intelligent Board Member Rodson, are part of the conspiracy to “kill” the truth about Doc Viray, who is reportedly in the US drinking milk and eating apples, smiling and laughing to his heart’s contents.

BONUS FOR CAPIZ EMPLOYEES
AFTER we wrote an item here about the possibility that the provincial employees of Capiz could not receive their Christmas bonus due to lack of funds, we received yesterday a text message saying that there is no truth to our report.
And that there is no truth either to the report that the previous administration had emptied the coffers of the provincial treasury on account of alleged massive graft and corruption.
The message stated that there is enough money for the yearend financial extravaganza.
The only problem is how to justify the disbursement.
It said the provincial management is just waiting for the guidelines from higher-ups.
Last year, each worker received between P10,000 to P15,000 each.
